About these terms

These Terms of Service ("Terms") apply to your use of borealpure.com and any purchase you make from Boreal Pure LLC ("Boreal Pure," "we," "us"). By using the site or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, Refund Policy and, if you subscribe, our Subscription Policy. If you do not agree, please do not use the site.

Who can buy

You must be at least 18 years old, or the age of majority where you live, to place an order. We currently sell and ship to addresses in the United States only.

Products and information

We try to describe our products accurately, including photos, weights and ingredients. Colors and appearance can vary slightly because Wild Haskap is a natural product. Information on this site, including nutrition and research content, is for general education only. It is not medical advice and is not intended to diagnose, treat, cure or prevent any disease. These statements have not been evaluated by the Food and Drug Administration. Talk to your doctor before changing your diet if you have a medical condition, are pregnant or nursing, or take medication. Always read the product label for allergen and ingredient information.

Prices and orders

Prices are in US dollars and do not include applicable taxes or shipping unless stated. We may change prices at any time, but a change will not affect an order you have already placed. Your order is an offer to buy. We may refuse or cancel any order, including for suspected fraud, an obvious pricing or listing error, or limited stock. If we cancel an order you have paid for, we will refund you in full.

Discount codes and promotions

Discount codes are limited to one use per customer unless stated otherwise, can't be combined with other discounts unless stated, have no cash value and may expire. Codes for one-time purchases can't be applied to subscriptions. We may end or change a promotion at any time, and we may cancel orders that use a code in a way that breaks its terms. Giveaways and contests have their own official rules, which apply in addition to these Terms.

Subscriptions

Subscriptions renew automatically until you cancel. The price, frequency, reminder emails and how to cancel are described next to the subscribe option and in our Subscription Policy. You can cancel online anytime from your account.

Payment

Payments are processed by Shopify and its payment partners. By providing a payment method, you confirm you are authorized to use it and you authorize us to charge it for your order, and for each renewal if you subscribe.

Shipping, risk and refunds

Shipping times and costs are described in our Shipping Policy. Our Refund Policy explains what happens if something is wrong with your order.

Email and text messages

If you sign up for marketing emails or texts, you can unsubscribe anytime. Text messages are covered by our SMS Terms. Message and data rates may apply.

Reviews and content you send us

If you post a review or send us photos, comments or other content, you confirm it is your own and honest, and you give us a non-exclusive, royalty-free, worldwide license to use, display and share it in connection with our business, including in marketing. Do not post content that is unlawful, misleading, offensive or that infringes anyone's rights. We may remove any content at our discretion.

Our content

The Boreal Pure name, logo, photos, illustrations, text and design of this site belong to Boreal Pure or its licensors. You may not copy or use them for commercial purposes without our written permission.

Acceptable use

Do not misuse the site, including by interfering with its operation, attempting to access accounts or data that are not yours, using bots to buy or scrape, or reselling products bought through promotions.

Disclaimers

The site and its content are provided "as is." To the fullest extent the law allows, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that the site will always be available or error-free.

Limitation of liability

To the fullest extent the law allows, Boreal Pure will not be liable for any indirect, incidental, special or consequential damages arising from your use of the site or our products. Our total liability for any claim related to an order is limited to the amount you paid for that order. Some states do not allow these limits, so they may not apply to you.

Indemnity

You agree to cover any claims, losses or costs, including reasonable legal fees, that arise from your breach of these Terms or your misuse of the site.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Pinellas County, Florida, unless the law where you live requires otherwise.

Changes to these Terms

We may update these Terms from time to time. The updated version applies from the date posted on this page and does not change orders already placed.
